Before you invest heavily in your trademark, we advise that you first conduct one of our clearance searches to be sure your mark is not actually someone else's! Then, we urge you to use our trademark application services. An attorney will oversee the creation of your trademark application paperwork, and will monitor the application as it works its way through the Patent & Trademark Office.

All Trademark Applications include:

  1. Attorney Review with client conference to clarify any issues that may cause problems
  2. Full Preparation of PTO Application paperwork, based on your inputs
  3. Electronic Filing of your mark with the PTO
  4. Monitoring of Application as it is processed by the PTO.

If, during the coarse of your trademark application, the PTO needs clarification of any issues, or if there is a problem with your registration, we'll first attempt to resolve the problem directly with the PTO, or contact you if further work is necessary.

Note: If you have not yet used the mark in interstate commerce, then when you do you'll have to submit samples of how you've used the mark with either a Statement of Use form or an Ammendment to Aledge Use form (each are $150 through us). You cannot get a federally-registered trademark until you've used the mark in commerce that the US federal government regulates (that is, interstate commerce or commerce with a foreign country). If you're going to be using the mark in interstate or international commerce soon, then you may wish to hold-off filing for the mark until then since it will cost $150 more as soon as you use the mark. After you receive a Notice-of-Allowance from the PTO, you'll have six months to either file one of these forms proving you're using the mark in interstate or international commerce, or you can file a six-month extension (also $150). You can file up to five extensions before your application will go abaondoned and you'll have to file a new one (losing your preparation and filing fees).
